Terms of Service

These Terms of Service (“Terms”) govern your use of the Vexy AI (“Vexy”, “we”) mobile application. By using Vexy, you represent that you have read, understood, and agreed to these Terms.

1. The Service

Vexy is an AI-powered companion app where users can exchange text messages with virtual characters driven by generative AI. Vexy is not a dating app, friendship site, or a platform for communication with real people.

Important: All characters in Vexy are generated by generative AI. They are not real people. Messages are automated outputs and do not reflect real feelings.

2. Age and Account

Vexy is for users aged 18 and older. By creating an account you represent that you are at least 18. One account per person.

You are responsible for keeping your credentials secure. Notify us immediately if you suspect unauthorized access.

3. Unacceptable Use

You agree not to:

  • Violate the rights of any other person or third party
  • Create or share unlawful, threatening, harassing, or hateful content
  • Attempt to generate content that sexualizes, endangers, or exploits minors (accounts deleted immediately; authorities notified)
  • Seek instructions related to terrorism, violence, weapons manufacturing, or similarly dangerous topics
  • Distribute malware, reverse-engineer the service, or access via automated tools
  • Use the service for commercial spam or unsolicited messages
  • Mislead others by presenting AI characters as real people to cause harm or spread misinformation

Our automated content moderation system inspects inbound and outbound messages. Violations may result in warnings, suspension, or permanent account closure.

4. User Content

You retain ownership of the messages you send. You grant Vexy the rights necessary to store, display, and process your messages to operate the service and maintain AI character consistency. Your messages are not used to train third-party AI models.

5. Nature of AI Conversations

  • AI characters are not real people and do not experience real feelings.
  • AI outputs may be inaccurate, misleading, or inconsistent. Do not rely on Vexy for professional medical, legal, financial, or psychological advice.
  • For crisis or urgent medical support contact professional help immediately: in the US 988 or 911; in Türkiye 182 or 112; elsewhere contact your local emergency services.
  • Vexy is for entertainment and companionship. It is not a substitute for human relationships, therapy, or professional medical, psychological, legal, or financial advice.

6. Paid Features and Purchases

6.1 Virtual Items (Gems)

Gems are a limited, personal, non-transferable, revocable license to access certain features. Gems have no monetary value, cannot be exchanged for cash or anything of value, and are non-refundable except where required by law. We may change the price, amount, or availability of Gems and of the items they unlock at any time. Unused Gems may be forfeited if your account is closed for a violation of these Terms.

6.2 Subscriptions

Vexy Premium is an auto-renewing subscription. The price and billing period are shown to you at the time of purchase. Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel anytime in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.

6.3 Consumable content

Once consumed (for example, an unlocked photo or a sent gift), digital content is non-refundable. All payments are processed by the Apple App Store or Google Play and are subject to their refund policies.

7. EU/UK Right of Withdrawal

If you are a consumer in the EU or UK, you normally have 14 days to withdraw from a purchase of digital content. By completing a purchase and accessing the content immediately, you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the content has been delivered. Your statutory consumer rights are otherwise unaffected.

8. App Store Terms

These Terms are between you and Vexy AI only, and not with Apple or Google. Apple and Google are not responsible for the app or its content. Your use of the app must also comply with the App Store Terms of Service and the Google Play Terms of Service, including Apple’s standard Licensed Application End User License Agreement. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you. Apple and Google have no obligation to furnish support or to address any claims relating to the app.

9. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Vexy AI and its team from any claims, damages, or expenses arising out of your misuse of the app or your violation of these Terms. This does not limit any mandatory consumer rights you have under applicable law.

10. Intellectual Property

The Vexy app, logo, characters, character artwork, and brand elements belong to Vexy AI. Except for personal, non-commercial use, they may not be copied, republished, or derived.

11. Changes and Termination

We may modify, suspend, or terminate the service with reasonable notice. Material feature changes will be announced in-app.

You may terminate your account at any time via Profile → “Delete account”. We may suspend or terminate accounts unilaterally for violations of these Terms.

12. Limitation of Liability

Vexy is provided “as is”. To the maximum extent permitted by applicable law, Vexy is not liable for indirect damages, lost profits, data loss, or consequences of decisions made based on AI output.

Consumer rights under applicable law remain unaffected — this clause does not limit any statutory consumer right.

13. Force Majeure

We are not liable for service disruptions caused by events beyond our control, including natural disasters, war, government action, or outages affecting our infrastructure or third-party service providers.

If you believe content in the app infringes your copyright, send a notice to support@vexyapp.com including: a description of the work, the location of the material, your contact details, and a statement of good-faith belief that the use is unauthorized. We respond to valid notices and may remove infringing material.

15. General

These Terms, together with the Privacy Policy, are the entire agreement between you and Vexy AI regarding the app. If any provision is found unenforceable, the rest remains in effect. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them. Our failure to enforce any right is not a waiver of it. Obligations that by their nature should survive termination will survive.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye. Disputes shall be resolved by the Istanbul Çağlayan Courts and Enforcement Offices. Consumers retain the right to file complaints with their local consumer arbitration boards.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will require re-consent in-app. If you do not accept the updated Terms, you must discontinue use.
